Job Description
Contracts Attorney - Agency Policy Specialist
The Contracts Attorney provides professional high level legal expertise and services relating to complex contract development, review and contract performance in multiple subject areas and issues throughout all of DHS. This attorney will (A) draft, review and approve contracts as to form, legal enforceability and execution; (B) negotiate contract legal issues with outside counsel including, but not limited to, intellectual property, indemnification and insurance issues; (C) provide legal contractual advice to Department staff and managers, other Department staff;

(D) develop and implement related training to Department staff and managers, other state agency staff, grantees and coordinate contract activities with other state agencies; and (E) facilitate and enhance Department contract staffs’ compliance with the statutory retainage requirement, the Department’s diversity and inclusionary goals in contracting, and ethics laws and state & Department ethics policies.

In addition, this attorney will demonstrate growth in knowledge and experience to (A) become one of the Department’s subject matter experts regarding the state contracting process, contracts of all types, and their legal requirements; (B) provide counsel and advice to Department staff pertaining to intellectual property, indemnification and insurance issues and other contract issues; (C) serve as one of the Department’s subject matter experts regarding the competitive proposal requirements contracts with complex competitive bidding requirements for Departmental programs; and (D) serve as one of the Department’s subject matter experts on data practices, including but not limited to Health Insurance Portability and Accountability Act (HIPAA) laws and regulations codified at 45 C.F.R. Parts 160, 162, and 164 (“HIPAA”) and the Minnesota Government Data Practices Act (Minn. Stat. Chapter 13).

Qualifications & Requirements
Minimum Qualifications:

Juris Doctorate (J.D.) from an American Bar Association accredited law school

Must be licensed to practice law in Minnesota and be in active status currently active license in another state and working toward attaining Minnesota licensure within one (1) year

•Knowledge of human services programs, including the laws and regulations governing these programs;Seven (7) years specialized professional experience in legal experience with at least one (1) year experience as a practicing attorney. Experience must demonstrate the followings:


•Judicial temperament and human relation skills necessary to conduct hearings in adversarial situations where there are communication barriers, and to manage a high volume caseload;


•Strong written and oral communication skills sufficient to, communicate to parties that appear before you and write clear, concise recommended orders that are easily understood by all parties;


•Excellent legal research and analysis skills; and


•Ability to work independently, prioritize work load, and allocate time in an efficient manner.


Preferred Qualifications:

•Experience conducting extremely complex work which includes the analysis and application of federal and state laws, regulations, agency rules, policy, hearing procedures, rules of evidence, code;


•Ability to communicate with people of varying educational levels and expertise;


•Ability to communicate in situations involving communication barriers, such as non English speaking persons, hearing-impaired persons, persons experiencing mental health issues, etc;


•Identify opportunities for mediation and the resolution of issues;


•Ability to resolve human conflicts in emotionally tense situations; and


•Ability to prioritize work load and allocate time in an efficient manners and case law.
